Types of Child Custody

Every family situation is different, which means every child custody agreement will be different. However, there are two main forms of custody that are settled upon in court: physical custody, where the child lives; and legal custody, who is responsible for the child. Depending on your situation, we might argue for joint or sole custody of your child.

  • Shared Parenting

In a Shared Parenting Plan, both parents are involved in making decisions for their child. The visitation schedule varies based on the parents’ availability to spend time with the child, the parents’ wishes, the child’s relationships with significant people in his/her life, the child’s adjustment to his/her community, the cooperation level of each parent and whether a household member harmed another child. Many parents in a shared parenting plan have an equal schedule of parenting time with their child, such as alternating every other week with each parent. The attorneys at Mackey Law, LLC will work with you to determine whether you have a shared parenting case, and the attorneys at Mackey Law, LLC will suggest multiple visitation schedules to determine what schedule of parenting time is in the best interest of your child.

  • Sole Custody

In a sole custody arrangement, one parent makes large decisions for the child (such as education and medical decisions). Parents in a sole custody arrangement have many different visitation schedules. The attorneys at Mackey Law, LLC will work with you to determine whether you have a sole custody case, and the attorneys at Mackey Law, LLC will suggest multiple visitation schedules to determine what schedule of parenting time is in the best interest of your child.
